What is the L1/EB-1C Visa Program?

L-1 Visa
The L-1 is a non-immigrant visa for employees of multinational companies transferring to a U.S. branch, affiliate, or subsidiary. It includes two categories:
- L-1A: For executives and senior managers.
- L-1B: For professionals with specialized knowledge.
The L-1 visa does not require labor certification and allows companies to sponsor foreign employees for internal transfer to the U.S. Importantly, the L-1A visa serves as a common pathway to a Green Card via the EB-1C category, offering a strong foundation for long-term U.S. residency.

The L1/EB-1C Program
This immigration pathway is designed for executives and senior managers of multinational companies who wish to expand their business operations to the U.S. while gaining a clear route to permanent residency. It consists of two main stages:
- L-1A Visa: Issued to qualified executives or managers from abroad transferring to a parent company, branch, or subsidiary in the U.S. This allows the individual to legally work and manage business operations.
- EB-1C Green Card: After a qualifying period of operations, the U.S. business can sponsor the individual for a Green Card under the EB-1C category, which does not require labor certification (PERM) — significantly reducing processing time.
This pathway empowers entrepreneurs and business leaders to build a presence in the U.S. while expanding their global footprint.

Program Eligibility Requirements
For the Sponsoring Company
(U.S.-based company)
For the Applicant
- Must have a legitimate relationship with the foreign entity (parent company, subsidiary, branch, or affiliate).
- Must be actively doing business in the U.S. and at least one other country throughout the duration of the L1A visa.
- If the U.S. entity is newly established, it must present a clear business plan and demonstrate the ability to sustain future operations.
- Must have worked for the foreign company for at least 1 year within the past 3 years prior to applying.
- Must have held an executive or managerial position, involving key decision-making, oversight of staff, or management of essential company functions.
- Must be entering the U.S. to continue working in a managerial or executive capacity at a qualifying affiliate company.

Roadmap to a U.S. Green Card (via L1/EB-1C)
U.S. Company Submits Form I-129 to USCIS
- The U.S. sponsor files Form I-129 (Petition for a Nonimmigrant Worker) to prove eligibility for the L1A visa.
- If the company uses an L1 Blanket Petition, the process may be faster.
USCIS Reviews the Petition
- Processing time: 2–6 months (or faster with Premium Processing, $2,805 fee, decision within 15 days).
Employee Applies for Visa & Attends Interview
- Once I-129 is approved, the applicant must complete Form DS-160, pay the visa fee, and schedule an interview at the U.S. Consulate.
- Required documents at the interview: passport, Form I-797 approval notice, employment proof, company financials, etc.
Receive Visa and Enter the U.S.
- Once approved, the visa will be stamped in the passport, allowing the applicant to enter the U.S. and begin employment.
U.S. Company Files Form I-140 (Petition for Alien Worker)
- The employer files Form I-140 on behalf of the employee to begin the EB-1C Green Card process.
File Form I-485 or DS-260
- After I-140 approval, the employee may file Form I-485 (Adjustment of Status) if they are in the U.S., or Form DS-260 through the U.S. consulate abroad to apply for an EB-1C immigrant visa.
Receive Your Green Card and Become a U.S. Permanent Resident
- Once Form I-485 or DS-260 is approved, the applicant will be granted lawful permanent resident (Green Card) status.
